1Parties to the Agreement

These Terms of Use («Terms») constitute a legally binding agreement between you («User») and AMCompany, a sole-proprietor business operated by Anyelo Moreno («AMCompany», «we», «us», «our»), the owner and developer of the mobile application ViralCam («Application»).

These Terms apply to all platforms on which ViralCam is available, including Google Play Store and Apple App Store, as well as to any future versions or updates of the Application.

2Description of the Service

ViralCam is a mobile video editing application that allows users to import, trim, and export videos enhanced with animated stickers, custom text overlays, additional audio tracks, and visual effects. The Application includes sticker content provided by third-party services and advertising functionality.

ViralCam offers two usage tiers:

The limits of the Free plan and the features of the Premium plan are defined and adjusted by AMCompany remotely at any time and without prior notice, as part of the normal operation of the Application. Current values can be checked directly within the Application.

3License to Use

AMCompany grants you a non-exclusive, non-transferable, revocable, and limited license to install and use ViralCam on devices you own or control, for both personal and commercial purposes, subject to compliance with these Terms.

The content you create, export, or publish using ViralCam is your sole responsibility, including any commercial use, public distribution, or monetization thereof. AMCompany assumes no responsibility for any legal, contractual, or other consequences arising from your use of content generated with the Application.

You are not authorized to:

• Copy, modify, adapt, translate, or create derivative works of the Application itself.
• Reverse engineer, decompile, or disassemble the Application or any part of it.
• Sublicense, sell, resell, or redistribute the Application as your own product or service.
• Remove or alter any copyright notices, trademarks, or other proprietary designations.
• Use the Application in any manner that violates applicable laws or regulations.

4Accounts and Access

ViralCam does not require account registration for basic use. Premium purchases and subscriptions are managed through the applicable app store (Google Play or App Store) and are subject to that platform’s terms. AMCompany does not store any payment data from users.

You are responsible for maintaining the security of your device and for any unauthorized access to the Application from it.

5Purchases and Premium Subscriptions

Premium features of ViralCam are available through in-app purchases managed by Google Play Store or Apple App Store. By acquiring a Premium subscription, you agree to:

• The terms and conditions of the distribution platform (Google or Apple) applicable to purchases.
• Payments being processed exclusively by Google or Apple, not by AMCompany.
• The availability of Premium features being subject to operational changes at any time.

Refund policy: Refunds are subject to the policy of the app store through which the purchase was made. AMCompany does not process refunds directly. To request a refund, please contact Google Play support or Apple App Store support as applicable.

6Local Data Processing and User Responsibility

ViralCam processes videos, images, and audio that you select from your device («User Content»). All processing takes place entirely and exclusively on your device. AMCompany does not upload, store, transmit, access, or retain any of your videos, images, audio files, or any other personal media on its own servers or any third-party servers under its control.

As a direct consequence of this local-only processing model, you acknowledge and accept that:

• AMCompany has no access to, and therefore no liability for, any content stored on your device.
• Any data loss resulting from device failure, accidental deletion, software errors, or Application uninstallation is your sole responsibility.
• AMCompany cannot and will not recover any content that is lost, corrupted, or deleted on your device.
• You are responsible for complying with any applicable laws regarding the content you store, edit, and distribute using the Application.

You represent and warrant that:

• You hold all rights, licenses, and permissions necessary for the User Content you process with the Application.
• Your User Content does not infringe intellectual property rights, privacy rights, publicity rights, or any other rights of third parties.
• Your User Content does not contain illegal, obscene, defamatory, violent, threatening material, or child sexual abuse material (CSAM).

AMCompany assumes no liability whatsoever for User Content processed or exported through the Application. Full responsibility for the use, distribution, and publication of User Content rests exclusively with you.

7Intellectual Property

The Application, including but not limited to its source code, design, graphical interface, logos, icons, text, and the selection and arrangement of its elements, is the exclusive property of AMCompany and is protected by applicable intellectual property laws.

The catalog of animated stickers and GIFs available within the Application is provided through integration with third-party services. Those stickers and GIFs are the property of their respective authors or rights holders and are subject to the corresponding usage licenses. AMCompany uses these services legitimately under the provider’s terms but does not transfer any rights over such content to the User beyond the use contemplated within the Application itself.

The use of stickers is limited to creating content within ViralCam. Extracting, redistributing, or using them outside the context of the Application is strictly prohibited.

8Third-Party Services

ViralCam integrates third-party services to provide certain functionalities. These services have their own terms of use and privacy policies, which apply to you independently:

AMCompany does not guarantee the continuous availability, accuracy, or suitability of content provided by third-party services. The interruption of any external service does not give rise to any claim against AMCompany.

9Advertising

ViralCam displays advertising through Google AdMob in the free version. Ads are provided by Google and are subject to Google’s privacy policy. AMCompany does not control the specific content of the ads displayed.

By using the free version, you consent to receiving advertisements within the Application, including banner ads and interstitial ads. You can remove ads by upgrading to the Premium plan.

10User Conduct

You agree not to use ViralCam to:

• Create, distribute, or promote illegal, violent, discriminatory, hate-based content, or content that incites illegal activities.
• Infringe intellectual property rights, privacy rights, or the right of publicity of third parties.
• Create or spread disinformation, malicious deepfakes, or content that impersonates another person without their consent.
• Distribute malware, spam, or any other harmful content.
• Perform any activity that interferes with the operation of the Application or its infrastructure.
• Circumvent, disable, or otherwise interfere with the security features of the Application.

Violation of these rules may result in suspension of access to the Application and, in serious cases, legal action.

11Privacy and Data

The collection and use of personal data is described in detail in our Privacy Policy, which forms an integral part of these Terms and is available on the Application’s page in both stores and on our website.

Key data handling principles in ViralCam:

• All video and audio processing is performed locally on your device. Your media files are never transmitted to AMCompany’s servers.
• Anonymous analytical data is collected through Firebase to improve Application stability and user experience.
• Google AdMob may collect device identifiers and usage data to personalize ads, subject to Google’s privacy policy.
• Premium purchase data is managed entirely by Google Play or App Store and is not accessible by AMCompany.

AMCompany complies with applicable obligations under the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other relevant privacy regulations applicable to the markets in which it operates.

12Disclaimer of Warranties

THE APPLICATION IS PROVIDED «AS IS» AND «AS AVAILABLE», without warranty of any kind, express or implied. AMCompany does not warrant, among other things:

• That the Application will be error-free, uninterrupted, or free of viruses.
• That the Application will be compatible with all devices or operating system versions.
• That third-party sticker content will be available continuously or without changes.
• That the video export results will be fit for any particular purpose.
• That data stored on your device will remain intact, accessible, or recoverable at any time.

Use of the Application is at your own risk. AMCompany shall not be liable for any damage resulting from the use of or inability to use the Application.

13Limitation of Liability

To the maximum extent permitted by applicable law, AMCompany, its owners, employees, agents, and suppliers shall not be liable for:

• Direct, indirect, incidental, special, consequential, or punitive damages.
• Loss of data, loss of profits, loss of reputation, or business interruption.
• Damages arising from third-party content integrated into the Application.
• Damages resulting from the inability to access or use the Application.
• Acts or omissions of third parties, including integrated service providers.
• Loss, corruption, or inaccessibility of any content or data stored solely on your device.

In jurisdictions that do not allow the full exclusion of liability, AMCompany’s liability shall be limited to the maximum amount permitted by applicable law or, alternatively, to the amount paid by the User for the Application in the 12 months preceding the event giving rise to the claim.

14Updates and Changes to the Application

AMCompany reserves the right to modify, update, suspend, or discontinue any aspect of the Application at any time, including features, free plan limits, available content, or integration with third-party services, with or without prior notice.

Updates may be required for the Application to function correctly. By installing updates from the app store, you accept any new terms if applicable.

15Modifications to These Terms

AMCompany may modify these Terms at any time. The updated version will be published on our website and on the Application’s pages in the stores, with the date of the latest update indicated.

Your continued use of the Application after the publication of material changes will constitute your acceptance of the new Terms. If you do not agree with the modifications, you must stop using the Application and uninstall it.

16Termination

These Terms remain in effect for as long as you use the Application. AMCompany may terminate or suspend your access immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, provisions that by their nature should survive will remain in effect, including those relating to intellectual property, disclaimer of warranties, and limitation of liability.

17Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Bolivarian Republic of Venezuela, without regard to conflict-of-law rules that might otherwise apply.

Any dispute arising out of or related to these Terms will first be attempted to be resolved through good-faith negotiation. If no agreement is reached within 30 days, the parties shall submit to the jurisdiction of the competent courts in the developer’s place of domicile, unless the law applicable in your country of residence provides otherwise.

For users in the European Union: nothing in these Terms shall affect the rights you are entitled to as a consumer under the consumer protection laws of your country of residence.

18General Provisions

• Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
• Waiver: AMCompany’s failure to exercise any right or provision of these Terms does not constitute a waiver of that right or provision.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and AMCompany with respect to your use of the Application.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without the prior written consent of AMCompany.
• Platform Compliance: These Terms do not limit or replace the terms of service of Google Play Store or Apple App Store, which also apply to your use of the Application.
